The fee tier is determined by the amount of the demand (current amount requested by Claimant). If no demand has been made, then the amount of the claim (full amount requested in the pleadings or otherwise) will be used to determine the appropriate tier. The amount(s) of any other claims, counterclaims, etc. will be added to this calculation. If the claim is not based on monetary values, arises from a venue outside of VA, MD, or DC, or is otherwise extraordinary, the fee will be assigned at our discretion based on the available information.

The hourly fee applies to all of the Neutral’s time, for example, pre-process calls, review of submissions, the process itself, and any post-process time including follow-up activities, as well as deliberation and award preparation (arbitration). Generally, travel time will be billed at 50% of the hourly fee; however, travel time expended on cases outside the Mid-Atlantic region (VA, MD, and DC) will be billed at 100% of the hourly fee. Third-party conference call charges, as well as all reasonable out-of-pocket expenses, will be billed in full.

Fees and expenses will be divided evenly among the parties unless otherwise agreed. (A party is defined as a single client or any number of clients represented by a single law firm.) The lawyer/law firm may be responsible for payment. If the lawyer/law firm does not wish to be the responsible payer (and in some instances, as required by TMG), it will be necessary for the party to establish a satisfactory retainer account with TMG before any professional services may be rendered.

There are no filing, continuance, cancellation, or administrative fees.
